These LitCharts Service Terms (the “Service Terms”) supplement the Learneo Terms of Service (together, the “Terms”) and apply to your use of the LitCharts website (the “Website”) and other websites that link to and reference these Service Terms (together, the “Services”). The Services are operated by Learneo, Inc. and its affiliates (“Learneo,” “we,” or “us”). In the event of a conflict between these Service Terms and the Learneo Terms of Service, these Service Terms shall govern solely with respect to matters relating to your use of the Services. For all other matters, the Learneo Terms of Service shall govern. Please read the Terms carefully.

I. Basics of Using the Services (Applicable to All Users)

Access and Use of LitCharts Content and Services. “LitCharts Content” means any material created, owned, or controlled by us for which we hold intellectual property rights or licenses sufficient to make it available through the Services, including but not limited to literature guides, poetry guides, translations, literary terms, concept explainers, theme explanations, and data visualizations. For the avoidance of doubt, LitCharts Content does not include AI Outputs (as defined in the Learneo Terms of Service). Subject to your compliance with the Terms, you may access, use, download, and print LitCharts Content available on the Website and Services for your personal and educational use only. LitCharts Content, including web pages, PDFs, software, photos, videos, graphics, music, sounds, and other media, is protected by copyright, trademark, trade secrets, and other proprietary rights in all forms and technologies, whether existing now or developed in the future. All LitCharts Content is copyrighted as a collective work under U.S. copyright law, and Learneo owns a copyright in the selection, coordination, arrangement, and enhancement of such content. Your access to LitCharts Content does not transfer any proprietary rights to you. Except as expressly provided in the Terms or with our written permission, you shall not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, or otherwise exploit any of the Services or LitCharts Content. Users with applicable subscriptions may share LitCharts Content with students for non-commercial educational purposes as further described in the Terms. Except for the licenses explicitly granted in the Terms, we reserve all rights, including all intellectual property rights, in and to the Services and LitCharts Content.
Ownership of LitCharts Content and the Services.
1. Proprietary Marks. LitCharts, LitCharts A+, LitCharts A+ Teacher, Shakescleare, and other identifying marks of LitCharts are proprietary to Learneo. You may not use these marks for any purpose without our prior written consent. Nothing in the Terms grants you any express, implied, or other license under any patent, trademark, or copyright of Learneo or any third party.
Permitted Use.
1. Sharing Printed Copies. You may distribute print copies of our downloadable LitCharts Content on the Website, such as literature guide PDFs and Teacher Edition files, for educational, non-commercial purposes. For example, a student may share printed materials within a study group, or a teacher may share LitCharts Content with their students. Any copies must retain, without modification, all copyright notices and proprietary markings.
2. Digital Distribution Prohibited. You may not upload, post, reproduce, or distribute digital versions of LitCharts Content, including printable literature and poetry guides, Shakespeare translations, and Teacher Editions, on any publicly accessible platform, including websites or mobile applications, without our prior written permission.
3. Derivative Works Prohibited. You may not modify, create derivative works from, or otherwise exploit any LitCharts Content or the Services, in whole or in part, including for use in creative work or to sell or promote other products or services. Notwithstanding the foregoing, your use of the AI Services made available by LitCharts on the Website (such as Discussion Question Generator, Essay Prompt Generator, and Quiz Question Generator) permits limited content generation from LitCharts Content solely for personal or non-commercial educational use, including sharing with students or others for educational purposes, unless otherwise permitted in writing by us.
Linking to LitCharts Content or Our Services. You may link to the Services or LitCharts Content without prior written permission. However, you must link to pages on LitCharts.com rather than directly to PDF files, so that Users can access and download our PDFs through authorized channels. Distributing or reproducing our PDF files without authorization may constitute a violation of copyright law and the Terms.

II. Other Important Terms

Artificial Intelligence.
1. AI Services. The Services may include AI Services. For Learneo’s general terms governing AI Services and AI Outputs, see the “AI Outputs” section of the Learneo Terms of Service.
2. Reporting concerns. If you encounter AI Outputs on the Services that you believe are inaccurate, harmful, or offensive, please contact us at support@litcharts.com.
Subscriptions. For more details on our available subscription plans, how to sign up for our Services, and what is included in the different levels of access, please see our Help Center.
Termination by You. You may stop using the Services at any time.
1. Unregistered Users. If you are not a registered User and do not have a User Account, you may discontinue your use of the Services at any time by ceasing all use of the Services.
2. Registered Users. If you have a User Account, you have two options:
  1. Cancel Your Subscription. If you would like to cancel your subscription but retain your User Account, cancel your subscription by logging into your “Account Settings”. For more information on how to cancel your subscription, please see our FAQ: Here.
  2. Delete Your User Account. If you would like to delete your User Account, you may do so at any time by logging into your “Account Settings”. For more information, please see our FAQ: Here.
3. Effect of Subscription Cancellation. If you cancel your subscription:
  1. Your premium access will continue until the end of your current billing period;
  2. Your User Account will remain intact and you may continue to access the free tier of the Services; and
  3. You will not receive a refund for any prepaid subscription fees.
4. Effect of Account Deletion. If you delete your User Account:
  1. Your User Account will be deleted and your subscription will be canceled immediately. You will no longer have access to your User Account;
  2. Any remaining subscription period will be forfeited and you will not be entitled to a refund of any prepaid subscription fees;
  3. We will not be able to provide you with Services to that User Account;
  4. You will not be able to use the email address associated with your deleted User Account to access the Services again; and
  5. This action cannot be undone.
5. Certain data associated with your User Account may be retained for a period of time after deletion as described in our Privacy Policy, including where retention is necessary to comply with legal obligations, resolve disputes, or as otherwise required by law.
Refunds. Subscription fees for paid services are nonrefundable as provided in the “Paid Services” section of the Learneo Terms of Service. We do not offer refunds if you find that the Services or LitCharts Content do not cover the material you expected. Because we have some LitCharts Content available for free, including free samples, we encourage you to review available previews before subscribing to determine whether our LitCharts Content meets your needs.
